Punishment and Retribution
by Leo ZaibertDiscussions of punishment typically assume that punishment is criminal punishment carried out by the State. Punishment is, however, a richer phenomenon and it occurs in many contexts. This book contains a general account of punishment which overcomes the difficulties of competing accounts. Recognizing punishment's manifoldness is valuable not merely in contributing to conceptual clarity, but in that this recognition sheds light on the complicated problem of punishment's justification. Insofar as they narrowly presuppose that punishment is criminal punishment, most apparent solutions to the tension between consequentialism and retributivism are rather unenlightening if we attempt to apply them in other contexts. Moreover, this presupposition has given rise to an unwieldy variety of accounts of retributivism which are less helpful in contexts other than criminal punishment. Treating punishment comprehensibly helps us to better understand how it differs from similar phenomena, and to carry on the discussion of its justification fruitfully.

Since its introduction, the clause has played a significant role in colonial and post-colonial constitutionalism in Commonwealth jurisdictions.This book is the first full length analysis of the various dimensions of the peace, order and good government clause. It argues that the origins of the POGG clause mark it out as an anachronistic feature of British constitutionalism when seen against a modern setting of human rights, liberty and democratisation. The book traces the history, politics and applications of the clause through the colonial period in Commonwealth territories to date. It provides critical evaluation of the POGG clause in a cross-continental enquiry, examining statutory, political and constitutional deployment in Australia, Canada, India, Nigeria, South Africa and the United Kingdom. The evaluation demonstrates that the POGG clause has relevance in a number of significant aspects of legal and socio-political ordering across the Commonwealth featuring prominently in the federalism question, emergency powers and the review of administrative powers. It maintains that while the clause is not entirely devoid of positive value, the POGG clause has been used not only to further the objects of colonialism, but also authoritarianism and apartheid. This book calls for a rethink of the prevailing subjective approach to the interpretation of the clause. The book will be of interest to students and academics of public law, human rights law, and comparative politics.

Cross-cultural Genre Analysis

The contribution of social work to mental health is indeed a continuing theme throughout this book. There are chapters on the juvenile courts; and a section on international aspects in which the philosophy of social work and its contribution to social change are discussed. At the time of publication the author was Adviser on Social Work Training at the National Institute for Social Work Training, and President of the International Association of Schools for Social Work. She had also been for some twenty-five years chairman of a London Juvenile Court and was chairman of the Working Party on Social Workers in the Local Authority Health and Welfare Services (Ministry of Health). She had been from time to time a Social Affairs Consultant to the United Nations and was a lecturer at the London School of Economics. To social workers, whether active at the time, or in training, she would have needed no introduction and they will have welcomed a book incorporating her immense experience and all the originality and clarity of thought they had learned to expect from her.
