Abortion in England 1900-1967
by Barbara BrookesOver the decades from 1900 to 1967 abortion was transformed from an important female-centred form of fertility control into a medical event, closely monitored by the State. This transition, the author argues here, took place against a background of debate over fertility control and its implications for women’s maternal role. The book, originally published in 1988, suggests that the inter-war years saw a crucial mapping of boundaries in the debates over abortion. The distinction between methods of fertility control used before and after conception was more sharply drawn. The abortion law was difficult to enforce and in 1936 the Abortion Law Reform Association was founded by feminists to call for safe legal abortion as a woman’s right. Resort to criminal abortion continued in the post-war years and the number of therapeutic abortions also began to increase. The medical profession’s attempt to create a distinction between worthy medical and spurious social reasons for fertility control gave way in the face of women’s demands for safe and effective means to plan when and if they would have children. After a hard-fought battle, the abortion law was reformed in 1967. The abortion decision, however, remained firmly in the hands of the medical profession.

Mediation Law
by Penny BrookerIn England mediation became a key part of the civil justice reform agenda after the Woolf Reforms of 1996, as disputants were deflected from litigation towards settlement outside the court system. The Civil Procedure Rules (CPR) give courts the power to ‘encourage’ mediation through judicial case management or use stronger measures by using costs to penalise parties who act unreasonably by refusing to use ADR or mediation. One of the effects of this institutionalisation is an emerging case law that defines how mediation is practiced as it is merges with the litigation process. When mediation first began to be used in England the parties either agreed to mediate by a contract before a dispute happened or decided to attempt the process as a way of resolving disagreements. Inevitably, some disputants either refused to abide by their contractual obligations or would not follow through with the settlement agreements reached through the process. This brought the authority of the law into a new area and the juridification process began. This book explores how mediation law shapes the practice of mediation in the English jurisdiction. It provides a comprehensive examination of the legal framework for mediation, and explores the jurisprudence in order to analyse the extent that institutionalisation by the state and courts has led to the monopolisation by lawyers and a further ‘juridification’ process results. The book includes a comparative legal methodology on the framework underpinning mediation practise in other common law jurisdictions, including the United States, Australia, and Hong Kong, in order to explicate shared or distinctive approaches to mediation. The book will be of great interest to academics and students of legal theory and dispute resolution.

Britain's Developing Constitution

The work of the State expanded, and the expansion was at several levels, delimited by the requirements of geography. Britain’s constitutional system has two aspects: one essentially theoretical, concerning such questions as the nature of sovereignty, prerogative powers, and the rights and duties of citizens; the other concerning the way in which the business of government is carried on: how people who make political decisions are chosen, how their activities are subject to checks and influence by the representatives of public interests, formal and informal. Originally published in 1974, this book deals with the second of these aspects. It identifies the changes in constitutional practice which had taken place in the previous two decades, and the trends which could be discerned at the time. It has four main sections. The first deals with the changing structure of government itself: with the recruitment of ministers, the nature of political responsibility and the changes in government departments. The second section deals with both Houses of Parliament, and particularly with the new forms of parliamentary discussion and criticism. The third deals with the process of election, including the regulation of propaganda and the use of the mass media. The final section deals with the different levels of government, including the local, the regional and the supra-national. All through the main concern is with the dynamic aspects of the political constitution. This was a really up-to-date and realistic book on British government at the time and now can be read in its historical context.
Policing in an Age of Austerity

Operating at both historical and contemporary levels, this book furnishes a mine of current information. Critically, it also emphasizes the extent to which British policing has traditionally concentrated on the lowest socio-economic stratum of society, to the neglect of the policing of the more powerful. Policing in an Age of Austerity will be of interest to academics and professionals working in the fields of criminal justice, development studies, and transitional and conflicted societies, as well as those with an interest in the social schisms caused by the current financial crisis.
