Wounded Feelings: Litigating Emotions in Quebec, 1870–1950 (Osgoode Society for Canadian Legal History)

Wounded Feelings is the first legal history of emotions in Canada. Through detailed histories of how people litigated emotional injuries like dishonour, humiliation, grief, and betrayal before the Quebec civil courts from 1870 to 1950, it explores the confrontation between people’s lived experience of emotion and the legal categories and terminology of lawyers, judges, and courts. Drawing on archival case files, supplemented by newspapers and contemporary legal writings, it examines how individuals narrated their claims of injured feelings, and how the courts assessed those claims, using legal rules, social norms, and the judges’ own feelings to validate certain emotional injuries and reject others. The cases reveal both contemporary views of emotion as well as the family, gender, class, linguistic, and racial dynamics that shaped those understandings and their adjudication. Examples include a family’s grief over their infant son’s death due to a physician’s prescription error, a wealthy woman’s mortification at being harassed by a conductor aboard a train, and the indignation of two Black men at being denied seats at a Montreal cinema. The book also traces an important legal change in how moral injury was conceptualized in Quebec civil law over the period, as it came to be linked to the developing idea of personality rights. By 1950, the subjective richness of stories of wounded feelings was increasingly put into the language of violated rights, a development with implications for both social understandings of emotion and how individuals presented their emotional injuries in court.

This book provides a comprehensive analysis of the remedies practice the European Commission has adopted on the basis of articles 7 and 9 of regulation 1/03. Using article 7 as a normative benchmark, it shows that most of the criticism levelled at the Commission's article 9 decisions and the Alrosa judgment of the CJEU is not justified, since critics tend to over-state both the rigour of article 7 and the laxness of article 9. Remaining inconsistencies between the commitment practice and the standards for infringement decisions can, it is submitted, be justified by the consensual nature of commitment decisions and their underlying goal of procedural economy. Moreover, it is suggested that too little importance is generally assigned to the beneficial effect which commitments bring about by providing for precise and enforceable obligations without sacrificing the concerned undertakings’ freedom to choose how to put the infringement to an end. Adopting a case-oriented approach, this study provides valuable insights for academics and practitioners alike.

Unyielding tackles a recurring topic of national importance as a history lesson for future generations. Controversial illegal medical mandates impacted military populations for many decades, but it was not until the COVID-era that the American people witnessed similar overreach. Colonel Tom &“Buzz&” Rempfer&’s memoir retraces the anthrax vaccine history since it marked the first time the military was served with court rulings condemning premeditated illegal experimentation on our nation&’s troops. The advent of COVID mandates, imposed on the population in 2021, gave the American people a taste of the mistreatment previously reserved for our nation&’s warriors. Legal protections enacted by the Congress to guard against medical experimentation, meant to ensure safe, effective, and FDA-approved products, were instead adulterated to foist mandates on American society. According to the FBI, the motive for the anthrax letter lab leaks in 2001 was to &“rejuvenate&” the &“failing&” anthrax vaccine. Similarly, the suspected Wuhan lab leak two decades later resulted in a push for COVID injections. The pattern of fear-based bioincidents resulting from reckless biodefense enterprises, and lessons not learned with illegal mandates, paralyzed government and military leaders while wreaking havoc on the trust and health of our troops and the American people. Buzz&’s decades-long analysis of the breakdowns stands as a unique treatise on the failures of leaders to learn lessons from these enduring clashes and to correct the damage. Future generations will sort out the aftermath, but in the meantime, Colonel Rempfer&’s Unyielding effort attempts to ensure that the lessons are not lost.

Theorising Institutional Change: The Impact of the European Integration Process on the Development of Space Activities in Europe (Springer Theses)

The book provides a structural analysis of the European space effort from an institute change perspective. It analyzes the EU-ESA inter-institutional relationship, gives an overview of the development of space policy in Europe, and advances the debate about the impact of the European integration process on existing institutional actors. While European Space collaboration was initially developed outside the competences of the European Union (EU) with space programmes being carried out almost exclusively under the framework of European Space Agency (ESA) and national agencies, the EU has gained “shared competences” (Art. 2, TFEU) in space policy following the adoption of the Lisbon Treaty. Currently the EU and ESA work together under a Framework Agreement. In 2016, the EU Commission has published a Communication entitled “European Space Policy” (ESP). Even though ESA’s Member States have agreed to keep ESA as an intergovernmental organisation during the ESA Ministerial Council of 2014, the discussion about ESA becoming part of the EU framework continues. The EU’s ambitions for leadership in European space policy raise question concerning the future of ESA. The study of institutions lies at the heart of political sciences. Strikingly the theoretic framework qualifying institutional change and making it comparable leaves room for more concrete and testable dimensions of institutional change.
