Decolonising the Neoliberal University: Law, Psychoanalysis and the Politics of Student Protest

by Jaco Barnard-Naudé

Taking the postcolonial – or, more specifically, the post-apartheid – university as its focus, the book takes the violence and the trauma of the global neoliberal hegemony as its central point of reference. Following a primarily psychoanalytic line of enquiry, it engages a range of disciplines – law, philosophy, literature, gender studies, cultural studies and political economy – in order better to understand the conditions of possibility of an emancipatory, or decolonised, higher education. And this in the context of both the inter-generational transmission of the trauma of colonialism, on the one hand, and, on the other, the trauma of neoliberal subjectivity in the postcolonial university. Oriented around an important lecture by Jacqueline Rose, the volume contains contributions from world-renowned authors, such as Judith Butler and Achille Mbembe, as well as numerous legal and other theorists who share their concern with interrogating the contemporary crisis in higher education. This truly interdisciplinary collection will appeal to a wide range of readers right across the humanities, but especially those with substantial interests in the contemporary state of the university, as well as those with theoretical interests in postcolonialism, psychoanalysis, gender studies, cultural studies, jurisprudence and law.

Decolonization, Sovereignty, and Peacekeeping: The United Nations Emergency Force (UNEF), 1956–1967

by Hanny Hilmy

This book analyses three major themes: decolonization, sovereignty, and peacekeeping. Their interaction during the national liberation struggle during the Cold War, culminating in the 1956 Suez War, addresses the principle of national sovereignty after World War II in the framework of the UN Charter. The new peacekeeping operations were used in many conflicts, during which the Charter’s theory and application were tested. The rise of the USA as the key Western power and Israel’s special role in the Middle East have created a new confrontational dynamic for the entire region. The interaction between the book’s main themes in the field has led to the principles of peacekeeping in international and national conflicts being reviewed in light of the discredited ‘Capstone Doctrine’. The author argues that state sovereignty is sacrosanct, but humanitarian interventions are equally imperative in his view. Striking the right balance is crucial for managing conflicts. The author:· offers a well-informed historical account and an authoritative political analysis· was exposed to UNEF deployments and termination and knows key peacekeeping actors· draws on original documents, memoirs, and interviews· includes unpublished photos and previously unavailable documentary material · has experience in government and academia

Decolonized Approaches to Human Rights and Social Work

by Mark Lusk Melinda Madew Marcin Boryczko

Despite committed effort to integrate postcolonial theory and decolonizing practices in human rights education in social work, there is scant literature offering a more balanced global perspective. This book addresses that need. Included here are discursive voices contributed by social work colleagues whose work is impacted by postcolonial realities. The task of decolonizing social work as a human rights profession calls for the inclusion of contesting perspectives from social work activists, human rights advocates and educators whose critical standpoints are drawn from the historical context of Global North-South relations. This book is essential given the many manifestations of global injustice, wars and climate catastrophes. The critical involvement of social workers in decolonized human rights advocacy is at no period in history, more urgent than now. The book: Engages readers in reflective discourse over the contentious manner human rights principles are referenced by social work practitioners within the context of contemporary North-South geopolitics Explores dilemmas, conflicts, challenges and limitations experienced by social workers worldwide while upholding human rights principles Uses critical case studies that expose how the vestiges of colonialism continue to impact communities Identifies areas of human rights advocacy where social work succeeds, and where it is confronted by limiting challenges Emphasizes the importance of human rights education and practice in the context of global inequalities Decolonized Approaches to Human Rights and Social Work provides models of good practice the world over in human rights advocacy. It is timely and essential reading for faculty who teach courses in social work, social development, community organization, human rights and social justice, as well as for students in social work, law, sociology, global studies and human rights. The book should draw readers who work in non-governmental organizations, international development agencies, advocacy groups, and community-based and grassroots organizations. International research centers, law clinics and organizations serving migrants and refugees would find it a useful resource.

Decolonizing Law: Indigenous, Third World and Settler Perspectives (Indigenous Peoples and the Law)

by Sujith Xavier; Beverley Jacobs; Valarie Waboose; Jeffery G. Hewitt; Amar Bhatia

This book brings together Indigenous, Third World and Settler perspectives on the theory and practice of decolonizing law. Colonialism, imperialism, and settler colonialism continue to affect the lives of racialized communities and Indigenous Peoples around the world. Law, in its many iterations, has played an active role in the dispossession and disenfranchisement of colonized peoples. Law and its various institutions are the means by which colonial, imperial, and settler colonial programs and policies continue to be reinforced and sustained. There are, however, recent and historical examples in which law has played a significant role in dismantling colonial and imperial structures set up during the process of colonization. This book combines usually distinct Indigenous, Third World and Settler perspectives in order to take up the effort of decolonizing law: both in practice and in the concern to distance and to liberate the foundational theories of legal knowledge and academic engagement from the manifestations of colonialism, imperialism and settler colonialism. Including work by scholars from the Global South and North, this book will be of interest to academics, students and others interested in the legacy of colonial and settler law, and its overcoming.

Decolonizing the Palestinian Mind

by Haidar Eid

Decolonizing the Palestinian Mind is a sharp critique of the Oslo surrender, the Israeli apartheid system established in the name of a two-state solution, and the tokenization of Palestinian struggle and emancipation. It calls for a radical change in consciousness in a new period of unprecedented pressure on Palestinian culture, identity, and futures. Drawing on the works of Edward Said, Ghassan Kanafani, Paolo Freire, Rosa Luxemburg, and Antonio Gramsci, Haidar Eid provides an in-depth look at how alternative political programs and struggles can offer prospects for a just peace.</p

Deconstructing Dignity: A Critique of the Right-to-Die Debate

by Scott Cutler Shershow

The right-to-die debate has gone on for centuries, playing out most recently as a spectacle of protest surrounding figures such as Terry Schiavo. In Deconstructing Dignity, Scott Cutler Shershow offers a powerful new way of thinking about it philosophically. Focusing on the concepts of human dignity and the sanctity of life, he employs Derridean deconstruction to uncover self-contradictory and damaging assumptions that underlie both sides of the debate. Shershow examines texts from Cicero’s De Officiis to Kant’s Groundwork of the Metaphysics of Morals to court decisions and religious declarations. Through them he reveals how arguments both supporting and denying the right to die undermine their own unconditional concepts of human dignity and the sanctity of life with a hidden conditional logic, one often tied to practical economic concerns and the scarcity or unequal distribution of medical resources. He goes on to examine the exceptional case of self-sacrifice, closing with a vision of a society—one whose conditions we are far from meeting—in which the debate can finally be resolved. A sophisticated analysis of a heated topic, Deconstructing Dignity is also a masterful example of deconstructionist methods at work.

Decoupling: Gender Injustice in China's Divorce Courts (Cambridge Studies in Law and Society)

by Ethan Michelson

Michelson's analysis of almost 150,000 divorce trials reveals routine and egregious violations of China's own laws upholding the freedom of divorce, gender equality, and the protection of women's physical security. Using 'big data' computational techniques to scrutinize cases covering 2009–2016 from all 252 basic-level courts in two Chinese provinces, Henan and Zhejiang, Michelson reveals that women have borne the brunt of a dramatic intensification since the mid-2000s of a decades-long practice of denying divorce requests. This book takes the reader upstream to the institutional sources of China's clampdown on divorce and downstream to its devastating and highly gendered human toll, showing how judges in an overburdened court system clear their oppressive dockets at the expense of women's lawful rights and interests. This book is a must-read for anyone interested in Chinese courts, judicial decision-making, family law, gender violence, and the limits and possibilities of the globalization of law. This title is also available as Open Access on Cambridge Core.

Decreation and the Ethical Bind: Simone Weil and the Claim of the Other

by Yoon Sook Cha

In Simone Weil’s philosophical and literary work, obligation emerges at the conjuncture of competing claims: the other’s self-affirmation and one’s own dislocation; what one has and what one has to give; a demand that asks for too much and the extraordinary demand implied by asking nothing. The other’s claims upon the self—which induce unfinished obligation, unmet sleep, hunger—drive the tensions that sustain the scene of ethical relationality at the heart of this book.Decreation and the Ethical Bind is a study in decreative ethics in which self-dispossession conditions responsiveness to a demand to preserve the other from harm. In examining themes of obligation, vulnerability, and the force of weak speech that run from Levinas to Butler, the book situates Weil within a continental tradition of literary theory in which writing and speech articulate ethical appeal and the vexations of response. It elaborates a form of ethics that is not grounded in subjective agency and narrative coherence but one that is inscribed at the site of the self’s depersonalization.

Deeds, Titles, and Changing Concepts of Land Rights: Colonial Innovations and Their Impact on Social Thought

by David Ress

This book explores the history of public land tenure records, which first began in colonial Massachusetts as English settlers and Native Americans tried to resolve differing ideas about rights to land in the seventeenth century. In South Australia, a similar method of state certification of land ownership arose in the nineteenth century, through Torrens system title registration – a process that would be widely adopted in British and American colonies as a particularly effective way of guaranteeing absolute ('fee simple') ownership over indigenous peoples’ land. This book explores the similarities between these two record systems, highlighting how similar settlement patterns and religious beliefs in both places focused attention on recording land tenure, and illustrating how these record systems encouraged new ways of thinking about rights to and on land.

Deep Agroecology and the Homeric Epics: Global Cultural Reforms for a Natural-Systems Agriculture (Earthscan Food and Agriculture)

by John W. Head

Drawing on the Homeric epics, this multidisciplinary work reveals the cultural transformations which need to take place in order to transition from today’s modern extractive agricultural system to a sustainable natural‐systems agriculture. In order to provide an imaginative foundation on which to build such a cultural transformation, the author draws on the oldest and most pervasive pair of literary works in the Western canon: the Iliad and the Odyssey. He uses themes from those foundational literary works to critique the concept of state sovereignty and to explain how innovative federalism structures around the world already show momentum building toward changes in global environmental governance. The book proposes a dramatic expansion on those innovations, to create eco‐states responsible for agroecological management. Drawing from many years of experience in international institutions, the author proposes a system of coordination by which an international agroecology‐focused organization would simultaneously (i) avoid the shortcomings of the world’s current family of powerful global institutions and (ii) help create and implement a reformed system of local landscape‐based agriculture wholly consistent with ecological principles. Acknowledging the difficulty of achieving reforms such as these, the author suggests that a new cultural‐conceptual narrative can be constructed drawing on values set forth 2,700 years ago in the Homeric epics. He explains how these values can be reimagined to drive forward our efforts in addressing today’s the climate and agricultural crises in ways that reflect, not reject, the natural processes and relationships that make the Earth a living planet. This book will be of great interest to students, academics and policymakers addressing issues of agrarian values, environmental and agricultural law, environmental restoration, agroecology, and global institutional reform.

Deep Delta Justice: A Black Teen, His Lawyer, and Their Groundbreaking Battle for Civil Rights in the South

by Matthew Van Meter

The "arresting, astonishing history" of one lawyer and his defendant who together achieved a "civil rights milestone" (Justin Driver). In 1966 in a small town in Louisiana, a 19-year-old black man named Gary Duncan pulled his car off the road to stop a fight. Duncan was arrested a few minutes later for the crime of putting his hand on the arm of a white child. Rather than accepting his fate, Duncan found Richard Sobol, a brilliant, 29-year-old lawyer from New York who was the only white attorney at "the most radical law firm" in New Orleans. Against them stood one of the most powerful white supremacists in the South, a man called simply "The Judge." In this powerful work of character-driven history, journalist Matthew Van Meter vividly brings alive how a seemingly minor incident brought massive, systemic change to the criminal justice system. Using first-person interviews, in-depth research and a deep knowledge of the law, Van Meter shows how Gary Duncan's insistence on seeking justice empowered generations of defendants-disproportionately poor and black-to demand fair trials. Duncan v. Louisiana changed American law, but first it changed the lives of those who litigated it.

Deep State Target: How I Got Caught in the Crosshairs of the Plot to Bring Down President Trump

by George Papadopoulos

The former advisor to President Trump shares an insider account of the investigation into Russian collusion in a memoir that &“unfolds like a spy thriller&” (Publishers Weekly). As a young, ambitious foreign policy advisor to Donald Trump&’s presidential campaign, George Papadopoulos became the first Trump official to plead guilty in special Counsel Robert Mueller&’s investigation into Russian interference in the 2016 election. He then became the first campaign advisor sentenced to prison. But as he explains in Deep State Target, there was an intricate set up at play, and it was neither Trump nor the Russians pulling the strings. American and allied intelligence services set out to destroy a Trump presidency before it even started. Here, Papadopoulos gives the play-by-play of how operatives like Professor Joseph Mifsud, Sergei Millian, Alexander Downer, and Stefan Halper worked to invent a Russian conspiracy that would irreparably damage the Trump administration. Papadopoulos was there: In secret meetings across the globe, on city streets being tailed by agents, and ultimately being interrogated by Mueller&’s team and agreeing to a guilty plea.

Deep State: Trump, the FBI, and the Rule of Law

by James Stewart

From bestselling author James Stewart, the definitive story of the war between President Trump and America's principal law enforcement agencies, answering the questions that the Mueller report couldn't – or wouldn't

When Trump fired James Comey, he triggered the appointment of Robert Mueller as an independent special counsel and caused the FBI to open a formal investigation into the President himself. This set in motion a chain of events, which would join in unprecedented and potentially mortal combat two vital institutions of American democracy: the Presidency and the Federal Bureau of Investigation, the investigative arm of the Department of Justice.

The stakes could not be higher: the rule of law itself, the foundation of the American constitution and Anglo-American democracy for centuries. In this epic battle, there is no room for compromise. There can only be winners and losers, to invoke a distinctly Trumpian view of the world. But there is plenty of room for collateral damage. The reputations of both sides have already been harmed, perhaps irrevocably, and at great cost to American democracy and its institutions.

Drawing on scores of interviews with key FBI, Justice Department, and White House officials, and voluminous transcripts, notes, and internal reports, Stewart tells the dramatic saga of the FBI and its simultaneous investigations of both Hillary Clinton and Donald Trump – the first time in American history the FBI has been thrust into the middle of both parties' campaigns for the Presidency. Packed with drama and a cast of fascinating characters, Deep State goes where others cannot, revealing the truth of the grand and world-changing struggle that has defined the Trump presidency.

A New York Times Bestseller
